1. Introduction

These Terms and Conditions (“Terms”) apply to all vehicle rentals and website use provided by Rental Cars NZ (“we”, “our”, “the Company”). By booking, renting, or using our services, you (“the Customer”, “you”) agree to be bound by these Terms. All rentals are governed by the laws of New Zealand, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

2. Driver Requirements

  • The minimum driver age is 21 years unless otherwise specified.
  • A valid full driver licence (New Zealand or International) must be presented at vehicle pickup.
  • The Company reserves the right to refuse rental if the driver does not meet safety or eligibility standards.

3. Booking and Payment

  • A booking is confirmed once payment or a deposit is received.
  • All prices include GST (15%) unless stated otherwise.
  • Additional fees may apply, including optional insurance, after-hours service charges, fuel charges, one-way fees, cleaning fees, and toll or infringement fees.

4. Changes and Cancellations

  • Bookings may be changed or cancelled subject to availability.
  • Free cancellation is available up to 48 hours before the scheduled pickup unless the chosen rate specifically prohibits cancellation.
  • “No-show” bookings and late cancellations may be fully non-refundable.

5. Vehicle Use

The Customer agrees to:

  • Use the vehicle only on public, sealed roads unless authorised.
  • Not permit unlisted drivers to operate the vehicle.
  • Not use the vehicle for racing, towing, commercial transport, off-road driving, or illegal activity.
  • Follow all New Zealand road rules and safety requirements.

The Customer is responsible for the vehicle from pickup until the vehicle is returned and inspected.

6. Insurance and Liability

  • All rental vehicles include basic insurance with an excess (deductible), the amount of which is stated at the time of booking.
  • Optional excess reduction packages may be available at an additional cost.
  • Insurance does not cover:
    • Driving under the influence of alcohol or drugs
    • Reckless or dangerous driving
    • Use of the vehicle off-road
    • Damage to tyres, windscreens, or interior unless covered by an additional insurance option
    • Lost keys or contamination of fuel

The Customer is liable for all costs arising from excluded events.

7. Fuel Policy

  • Standard policy is Full-to-Full: the vehicle is supplied with a full tank and must be returned full.
  • If the vehicle is returned with less fuel, refuelling charges and service fees apply.

8. Breakdowns and Roadside Assistance

  • Customers must notify the Company immediately in the event of mechanical issues.
  • Roadside assistance is included where applicable; misuse-related callouts may incur fees.
  • A replacement vehicle may be provided subject to availability.

9. Traffic Offences and Fines

The Customer is responsible for any:

  • Speeding fines
  • Parking tickets
  • Toll charges
  • Traffic infringements

An administration fee may apply for processing such charges.

10. Limitation of Liability

The Company is not responsible for:

  • Loss or damage to personal belongings
  • Indirect or consequential losses
  • Events outside our reasonable control, including weather, natural disasters, and road closures

Our liability is limited to the extent permitted by New Zealand law.

11. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in New Zealand courts.
